China further refines scope of procuratorial public-interest litigation cases in draft law

BEIJING, June 23 (Xinhua) -- Chinese lawmakers are advancing a draft law aimed at further strengthening the work of public-interest litigation by procuratorial agencies and enhancing protection of national and public interests.

The draft law on procuratorial public-interest litigation was submitted on Tuesday to the ongoing session of the Standing Committee of the 14th National People's Congress, the national legislature, for its second reading.

The draft further refines and expands the scope of procuratorial public-interest litigation cases and adds provisions on foreign-related cases.

Specifically, the draft stipulates that procuratorial agencies shall, in accordance with the law, bring public interest litigation against illegal acts committed by foreign organizations and individuals that infringe upon China's national and public interests.

It also seeks to further improve the procedural rules governing procuratorial public-interest litigation and ensure consistency with other procedural laws.

The draft adds that people's congresses at all levels and their standing committees shall supervise the work of procuratorial public-interest litigation. It also stipulates that people's procuratorates and people's courts handling public-interest litigation cases shall be subject to public oversight.

The draft law was submitted for initial review last October.
